Conditions
Governing the Reproduction of Works of Art
-
Requests
for permission to reproduce an image for publication, printed or
electronic, must be made in writing to the Wolfsonian and should
include the intended use, (including edition number, intended area of
distribution and number of languages to be used), the publisher, title
of the publication, and expected date of publication.
-
Reproduction
is permitted only from materials provided by the Wolfsonian.
- Permission
is granted for only one usage, one edition, and in one language.
Additional languages editions and subsequent revised editions will
be considered upon application and will be subject to required
fees. Photographic material may not be reused without the written
permission of the Wolfsonian.
- The
complete credit line must appear in immediate proximity to
the image, or in the section devoted to photographic credits. No
abbreviations are permitted. In the case of filmstrips, films,
videos or television, visual credits must appear in the credits,
at the beginning or at the end.
- A
color proof must be approved by the Wolfsonian
before reproduction of a color image. If a proof is not judged to
be of reasonably sufficient quality by the Wolfsonian (that is, it
is not a sufficiently similar match to the original), even after correction,
the Wolfsonian has the right to withdraw permission to publish.
- All
negatives, internegatives and color transparencies remain the
property of the Wolfsonian.
- Each
image must be reproduced unaltered and in its entirety unless
approved in writing by the Wolfsonian. The reproduction must not
be cropped, bled off the page, printed on color stock or with
colored ink, or have anything superimposed on the image. A
specific detail must be approved in advance and in writing by the
Wolfsonian, and the word "detail" must be included in
the credits.
- No
materials are available on approval. Rental fees and costs of
photographic materials (prints and slides) are payable before
release of materials from the Wolfsonian, whether or not the
image(s) is reproduced. Failure to pay the required fees for
reproduction indicates that permission to reproduce has not been
granted.
- In
addition to the transparency rental fee, a charge equal to the
replacement cost will be made for any color transparency not
returned within four months or returned in damaged condition.
- Upon
date of publication, the publisher is to provide the Wolfsonian
with two complete, gratis copies of the publication in which the
image is reproduced. Send: Attention Rights and Reproductions.
- Permission
is valid for a period of two years. If the publication has not
appeared at the end of that time, permission is automatically
revoked and must be requested again.
- The
permission granted terminates immediately upon publication.
- The
Wolfsonian reserves the right to deny permission to reproduce an
image from the collection to any applicant whose product is not
acceptable to the Wolfsonian for any reason. Special permission
must be obtained in writing from the Wolfsonian if any work of art
is to be used for promotional material. Permission will not be
granted for a work of art to be used as a symbol in any
presentation, publication or film.
- The
Wolfsonian assumes no responsibility for infraction of copyright
laws, invasion of privacy or improper or illegal use that may
arise from reproduction of images.
